In accordance with the provisions of the Federal Act on the Protection of Personal Data in Possession of Individuals (hereinafter, the “Law”), the Regulations of the Federal Act on the Protection of Personal Data in Possession of Individuals (hereinafter, the “Regulations”), and the Privacy Notice Guidelines (hereinafter, the “Guidelines”), and together with the Law, and the Regulations, the “Applicable Legislation”), the Trust identified with number and name F/055 Fideicomiso Pro Bosque de Chapultepec (hereinafter, and indistinctly, the “Trust”, “We”, and/or “Us”), makes this comprehensive privacy notice (hereinafter, the “Privacy Notice”), available to its donors, shoppers with cause, potential donors, users and visitors of the mobile app Pro Bosque Chapultepec (hereinafter, the “App”) and the website https://www.chapultepec.org.mx/ (hereinafter, the “Site”), with respect to whom it processes personal data (hereinafter and indistinctly, “You” and/or the “Data Subject”).

Please note that your contribution to Fideicomiso Pro Bosque de Chapultepec does not qualify for a tax deduction as a charitable contribution under IRC Section 170. We recommend consulting with your tax advisor for further information.

  1. Identity and Address of the Controller

The Trust, domiciled at Jardín Botánico, First Section of the Chapultepec Forest, Paseo de Reforma Av., San Miguel Chapultepec, Miguel Hidalgo municipality, Zip Code 11850, Mexico City, will be the controller of the personal data that You provide Us, to process it in accordance with the provisions of this Privacy Notice.

  1. Personal data to be collected

The Trust will collect, through the App and the Site, the data detailed hereunder, in accordance with Section III of this Privacy Notice:

1)          If you are a natural person donor or shopper with cause: (i) name(s), surname(s); (ii) address, which includes street, number, neighborhood or town, municipality, postal code, state and country; (iii) phone number(s); (iv) e-mail; (v) Federal Taxpayers’ Registry; (vi) tax data; (vii) bank data; (viii) birthdate; (ix) personal photo; and (x) IP address and browsing data (webpages visited, the way You use those webpages, the frequency of visits to those webpages, and the sections visited).

2)          If you are a natural person potential donor: (i) name(s), surname(s); (ii) address, which includes street, number, neighborhood or town, municipality, postal code, state and country; (iii) phone number(s); (iv) e-mail; (v) official identification; and (vi) IP address and browsing data (webpages visited, the way You use those webpages, the frequency of visits to those webpages, and the sections visited).

3)          If You are a user of the App (hereinafter, (“User”): (i) name(s), surname(s); (ii) phone number(s); (iii) e-mail; (iv) photos; (v) gender; (vi) birthdate; (vii) age; and (viii) IP address and browsing data (webpages visited, the way You use those webpages, the frequency of visits to those webpages, and the sections visited).

4)          If You are a visitor of the App and/or of the Site (hereinafter, (“Visitor”): (i) IP address and browsing data (webpages visited, the way You use those webpages, the frequency of visits to those webpages, and the sections visited).

The personal data collected through the App and the Site will be hereinafter referred to as “Data”.

The Trust states that, regarding the purposes stablished in Section III of this Privacy Notice, we will not request in any way, and you will not provide us at any time, ‘sensitive personal data’, i.e. those personal data which are intimate or the misuse of which may lead to discrimination or entail a serious risk for You. In particular, you undertake not to provide us with any data relating to your racial or ethnic origin, state of health, genetic information, religious, philosophical and/or moral beliefs, trade union membership, political opinions and/or sexual preference.

The Data that you provide Us, will be kept in different secure means as our technology allows it, and the access to this information will be limited only to individuals and/or legal entities with whom we share your information. We consider that we have adequate security measures in place to protect the use of this information by unauthorized third parties. In the event of a request from any authority, your Data, as well as the data of the legal entity if any, may be made available to it, within in strict compliance with the applicable legal orders.

On another topic, regardless of the Data that is collected by the Trust, including those related to Legal Entities, collective donation fundraising platforms, intermediaries and banking institutions used for the payment procedure of the donations that you make, may collect additional data. The legal entities referred to are the following: “Donorbox“, “Paypal” and “Stripe“, whose websites are https://donorbox.org/, https://www.paypal.com/ and https://stripe.com/es (the “Platforms”), as well as the banking institutions with which You process your donation payment. The platforms and banking institutions may collect additional data in accordance with the Platforms’ own privacy notice. Likewise, the Platforms are used by the Trust to facilitate project fundings, and providing different payment method options, in order to fulfill the social purpose of the Trust.

In order for you to know the general information of the three platforms that we use as a means of payment and their respective privacy notices, which we refer to in the previous paragraph, we point out the following:

The Platform “Donorbox” is operated by the foreign company called “Rebel Idealist, Inc”, headquartered at 1520 Belle View Blvd #4106, Alexandria, VA 22307, United States of America and, in accordance with the laws of such country. Any information you provide to the Platform will be subject to the privacy notice available on the website https://donorbox.org/privacy. The Platform controls all information provided by its users for the provision of its own services and the Trust does not intervene in any way in the collection of personal data from the Data Subject. To do so, before making a donation through this Platform, You must accept the terms and privacy policies of the latter.

The “Paypal” platform is operated by “PayPal de México, S. de R.L. de C.V”, headquartered at Av. General Mariano Escobedo 476, Piso 14, Colonia Nueva Anzures, Miguel Hidalgo, Ciudad de México, México, C.P. 11590. Any information you provide to the Platform will be subject to the privacy notice available on the website https://www.paypal.com/mx/webapps/mpp/ua/privacy-full. The Platform controls all information provided by its users for the provision of its own services and the Trust does not intervene in any way in the collection of personal data from the Data Subject. To do so, before making a donation through this Platform, You must accept the terms and privacy policies of the latter.

The Platform “Stripe” is operated by “Stripe Payments Mexico, S. de R.L. de C.V”, headquartered at Paseo de La Reforma No. 295 Int. A Piso 8, Cuauhtémoc, Cuauhtémoc, 06500 Mexico City. Any information you provide to the Platform will be subject to the privacy notice available on the website https://www.paypal.com/mx/webapps/mpp/ua/privacy-full. The Platform controls all information provided by its users for the provision of its own services and the Trust does not intervene in any way in the collection of personal data from the Data Subject. To do so, before making a donation through this Platform, You must accept the terms and privacy policies of the latter.

III.         Purposes of the Data processing

The Data that you provide us as a donor or shopper with cause, as well as the Data of the legal entity if applicable, are necessary for the Trust in order to achieve the following purposes: (i) identify, locate, and contact you; (ii) issue the corresponding tax voucher; (iii) record You in our database; (iv) keep track on your contribution; (v) issue any communication related to marketing and advertising efforts; and (vi) analyze the browsing behavior and tendencies of the Data Subject.

On the other hand, the Data that you provide us as a potential donor, as well as the data of the legal entity, if applicable, are necessary for the Trust to achieve the following purposes: (i) identify, locate, and contact you; (ii) register You in our database; (iii) follow up on your interest in donating; (iv) issue any communication related to marketing and advertising efforts; and (v) analyze the browsing behavior and tendencies of the Data Subject.

The Data that you provide us as a User are necessary for the Trust to achieve the following purposes: (i) provide the digital space for Users to upload photos and videos captured during their visit at the Trust´s park and events; (ii) allow the interaction between users of the App; (iii) analyze the browsing behavior and tendencies of the Data Subject; (iv) promote content in the Trust’s social media, utilizing the photographs uploaded to the App by the Data Subject; and (v) issue any communication related to marketing and advertising efforts, whether through push notifications in the App or via email.

Finally, the Data that you provide us as a Visitor are necessary for the Trust to achieve the following purposes: (i) analyze the browsing behavior and tendencies of the Data Subject.

The purposes contained in the numerals (i) to (iv) regarding Data of donors and shoppers with cause; items (i) to (iii) of the potential donors; and numerals (i) and (ii) of Users, are necessary for the existence, maintenance, and fulfillment of the legal relationship between the Trust and the Data Subject, therefore, if we do not have this information, we will not be able to comply with this relationship.

Since the purposes (v) and (vi) of donors and shoppers with cause; (iv) and (v) of potential donors; (iii), (iv) and (v) of Users; and (i) of Visitors, are not necessary for the existence of a legal relationship between the Trust and the Data Subject, the latter may request that we stop using his/her Data for the effects of such purpose. To do so, the Data Subject must send us a letter confirming the above to the e-mail address indicated in Section V; or, the Data Subject must fill out the information required in the form at the bottom of this Privacy Notice and send it to us at the e-mail address referred to in this paragraph.

  1. Transfers that we will make of the Data

In order to comply with the purpose of this Privacy Notice, We may transfer your Data to natural persons and legal entities, who will be service providers of the Trust, in legal, accounting and/or consulting and business development. Consequently, your consent will not be necessary.

The Trust may also transfer your Data to individuals and legal entities, who will provide the Trust with marketing and advertising services. In such cases, You may object to this transfer in accordance with the procedure established in Section V of this Privacy Notice; or, the Data Subject must fill out the information required in the form at the bottom of this Privacy Notice and send it to us at the e-mail address referred to in this paragraph.

The transfers detailed in this Section IV, may be carried out both nationally and internationally.

The Trust declares that the Data will not be subject to any additional transfer, unless it is necessary for the fulfillment of the obligations derived from the legal relationship it has with the Data Subject; or, if any of the exceptions set forth in Article 37 of the Law are met, in which case the Trust will issue a new privacy notice to the Data Subject, in compliance with the provisions of Articles 68 of the Regulations and the Twelfth of the Guidelines.

  1. Data Subject’s Rights
  2. A) ARCO Rights

You will be entitled, at all times, to: (i) Access your Data held in the Trust’s databases; (ii) Rectify your Data in cases where the information is inaccurate or incomplete: (iii) Cancel your Data when the legal relationship with the Trust has ended; and (iv) Object the processing of your Data for specific purposes (hereinafter, the “ARCO Rights”).

In order to execute the ARCO Rights, you shall submit your respective written request to us in a digital format, to the PRO BOSQUE DE CHAPULTEPEC Administrative Area, which email is the following: contacto@probosquedechapultepec.org.

The request to enforce ARCO Rights must contain, and be accompanied by, the following: (i) the name of the Data Subject; (ii) his/her e-mail, address, and/or any other means of communicating the response to its request; (iii) the official documents proving the identity of the Data Subject or, where applicable, the legal representation of the latter; (iv) a clear and precise description of the Data in respect of which the exercise of any of the ARCO Rights is intended; (v) any other element or document that facilitates the location of the Data; and (vi) if applicable, exhibit the documentation that supports the origin of the corrections requested.

Once the request to exercise the ARCO Rights has been sent, the Data Subject must confirm its receipt with the PRO BOSQUE DE CHAPULTEPEC Administrative Area, at the telephone number +52 (55) 5281.5382. The Personal Data Protection Area of PRO BOSQUE DE CHAPULTEPEC, will have a period of 20 (twenty) business days to provide an answer on the validity, or inadmissibility of your request. If your request is valid, the respective area will have 15 (fifteen) business days to grant the request. The foregoing subject to the terms set forth in the Law, which may be extended only once for an equal period, provided that it is justified by the circumstances of the case.

In case the information is not clear or sufficient, the corresponding area will require the necessary information and/or documents, which must be submitted within 5 (five) business days, if it is not done in time and form, the request will be deemed not submitted. On the other hand, in those cases in which the Data Subject exercises his/her right of access to information, the Trust will comply by making the corresponding Data available to the Data Subject, issuing simple copies, electronic documents or any other means that allows the Data Subject to access his/her Data.

  1. B) Withdrawal of consent; and Limitation on the use or disclosure of Data

The Data Subject can withdraw, at any time, the consent granted to the Trust for the processing of his/her Data, and request the limitation on the use or disclosure of the latter, only if it is not prevented by a legal provisions and/or your request is not applicable in terms of the Law.

For those effects, the Data Subject must submit a written request in digital format to the Public Relations Area of PRO BOSQUE DE CHAPULTEPEC, at the following e-mail address: contacto@probosquedechapultepec.org.

The request must contain (i) the name of the Data Subject; (ii) address or email to receive notifications; as well as (iii) documents proving the identity or powers of attorney corresponding to the legal representative of the Data Subject. The response to your request will be notified to you at the address or email that you have indicated for such effects and, if the response is valid, it will be effective within 15 days after the date on which the response was communicated. The foregoing subject to the terms set forth in the Law, which may be extended only once for an equal period, provided that it is justified by the circumstances of the case.

However, the Data Subject may obtain more information about the status of his/her request and the deadline for responding to it, by contacting the Trust or sending a request to the aforementioned e-mail, where they can also address any clarification or doubt that the Data Subject may have regarding the processing of his/her Data and his/her respective rights contained in this Privacy Notice.

If the Data Subject wishes to exercise his/her right to limit the use or disclosure of the Data and/or to stop receiving the Trust’s newsletter, he/she may unsubscribe from it at any time by clicking on the “unsubscribe” option at the end of all its communications. The disclosure of your Data is limited to the transfers referred to in Section IV above, which are indispensable to process the donations and issue the tax vouchers required by the Data Subject.

Additionally, the Data Subject may also go to or request by telephone its registration in the Public Registry of Consumers, and/or the Public Registry to Avoid Advertising, as provided in this regard by the Federal Consumer Protection Agency, through the applicable legislation. The Data Subject may also go to the Public Registry of Users provided by the Law for the Protection and Defense of the Financial Services User, in order to limit the use of personal data in possession of individuals.

  1. Remote means and technologies

If for any reason you provide us with your Data through electronic means, including in the Site and the App, You understand, and agree that:

  1. The Site and the App may include links to third party websites which, if accessed, will cause our Site or App to be abandoned, so we assume no responsibility in relation to third party websites;
  2. The Site and the App may include links to sites that administer social networks, in which case you agree that by providing any information, including your Data on such sites, it will cause it to be read, viewed, accessed, retransmitted, and processed by anyone, freeing us from any liability; and

III.         The Site, the App and our systems, including the Platform, may collect data in addition to what you provide Us, such as browser type, operating system, internet pages visited, IP address, etc. This is done through the use of cookies or web beacons, of our own and from third parties. In no case do cookies personally identify the users of the Site and App. The cookies may be disabled in accordance with the settings on the use of cookies of the browser or Internet service that the Data Subject uses. However, we inform you that the blocking by the Data Subject of all cookies may result in the total or partial blocking or impairment of access to and use of the Site.

On the other hand, we use “Google Analytics” services to analyze how users use the Site, including how often it is visited, previous sites and sections visited, this information is only used to improve and enhance our Site and service. The ability to use and store your information through Google Analytics when you visit the Site, is governed by the terms and privacy policies of Google Analytics and Google. Privacy policies for Google Analytics and Google can be found at www.google.com/policies/privacy/partners/.

Likewise, we use “Facebook Ads” services to enhance communication with potential donors who are interested in the cause, so the Site has the tool known as “Facebook Pixel “installed accordingly, which allows us to improve our communication through advertisements. The ability to use and store your information through Facebook is governed by the terms and privacy policies of Facebook. Privacy policies for Facebook can be found at https://www.facebook.com/policies/ads/#, at the bottom of its webpage.

VII.        Amendments to the Privacy Notice

This Privacy Notice may be modified by Us to be consistent with applicable legal requirements at the request of the appropriate authorities and/or as We deem appropriate.

As long as we do not modify our identity, require more data from you than those mentioned herein, modify the purpose of this Privacy Notice, and/or change the terms of transfer, You understand and agree that the way to notify any change to this Privacy Notice, will be through its publication on the Site and/or the App. In the event that your consent is required for changes made to this Privacy Notice, We will notify You by any of the means of contact you have provided.

You will be deemed to have accepted the changes to the Privacy Notice until we receive any communication from you to the contrary. It is your obligation to periodically visit the Site in order to verify the most current version of our Privacy Notice.

The Privacy Notice will be governed by the laws of Mexico City without regard to its conflicts of law provisions. Any disputes, claims, and causes of action arising out of or in connection with this Privacy Notice, will be resolved individually, without resort to any form of class action. Any action or litigation concerning the Privacy Notice shall take place exclusively in the federal or state courts sitting in Mexico City, and each Data Subject expressly consents to the jurisdiction of and venue in such courts and waives all defenses of lack of jurisdiction and inconvenient forum with respect to such courts. Each Data Subject agrees to notify by mail or other method acceptable under the laws of Mexico City.

The present Privacy Notice is drafted in English and Spanish. The interpretation and compliance with this Privacy Notice shall be under the Spanish version.

The Data that you provide us as a User are necessary for the Trust to achieve the following purposes: (i) provide the digital space for Users to upload photos and videos captured during their visit at the Trust´s park and events; (ii) allow the interaction between users of the App; (iii) analyze the browsing behavior and tendencies of the Data Subject; (iv) promote content in the Trust’s social media, utilizing the photographs uploaded to the App by the Data Subject; and (v) issue any communication related to marketing and advertising efforts, whether through push notifications in the App or via email.

Finally, the Data that you provide us as a Visitor are necessary for the Trust to achieve the following purposes: (i) analyze the browsing behavior and tendencies of the Data Subject.

The purposes contained in the numerals (i) to (iv) regarding Data of donors and shoppers with cause; items (i) to (iii) of the potential donors; and numerals (i) and (ii) of Users, are necessary for the existence, maintenance, and fulfillment of the legal relationship between the Trust and the Data Subject, therefore, if we do not have this information, we will not be able to comply with this relationship.

Since the purposes (v) and (vi) of donors and shoppers with cause; (iv) and (v) of potential donors; (iii), (iv) and (v) of Users; and (i) of Visitors, are not necessary for the existence of a legal relationship between the Trust and the Data Subject, the latter may request that we stop using his/her Data for the effects of such purpose. To do so, the Data Subject must send us a letter confirming the above to the e-mail address indicated in Section V; or, the Data Subject must fill out the information required in the form at the bottom of this Privacy Notice and send it to us at the e-mail address referred to in this paragraph.

  1. Transfers that we will make of the Data

In order to comply with the purpose of this Privacy Notice, We may transfer your Data to natural persons and legal entities, who will be service providers of the Trust, in legal, accounting and/or consulting and business development. Consequently, your consent will not be necessary.

The Trust may also transfer your Data to individuals and legal entities, who will provide the Trust with marketing and advertising services. In such cases, You may object to this transfer in accordance with the procedure established in Section V of this Privacy Notice; or, the Data Subject must fill out the information required in the form at the bottom of this Privacy Notice and send it to us at the e-mail address referred to in this paragraph.

The transfers detailed in this Section IV, may be carried out both nationally and internationally.

The Trust declares that the Data will not be subject to any additional transfer, unless it is necessary for the fulfillment of the obligations derived from the legal relationship it has with the Data Subject; or, if any of the exceptions set forth in Article 37 of the Law are met, in which case the Trust will issue a new privacy notice to the Data Subject, in compliance with the provisions of Articles 68 of the Regulations and the Twelfth of the Guidelines.

  1. Data Subject’s Rights
  2. A) ARCO Rights

You will be entitled, at all times, to: (i) Access your Data held in the Trust’s databases; (ii) Rectify your Data in cases where the information is inaccurate or incomplete: (iii) Cancel your Data when the legal relationship with the Trust has ended; and (iv) Object the processing of your Data for specific purposes (hereinafter, the “ARCO Rights”).

In order to execute the ARCO Rights, you shall submit your respective written request to us in a digital format, to the PRO BOSQUE DE CHAPULTEPEC Administrative Area, which email is the following: contacto@probosquedechapultepec.org.

The request to enforce ARCO Rights must contain, and be accompanied by, the following: (i) the name of the Data Subject; (ii) his/her e-mail, address, and/or any other means of communicating the response to its request; (iii) the official documents proving the identity of the Data Subject or, where applicable, the legal representation of the latter; (iv) a clear and precise description of the Data in respect of which the exercise of any of the ARCO Rights is intended; (v) any other element or document that facilitates the location of the Data; and (vi) if applicable, exhibit the documentation that supports the origin of the corrections requested.

Once the request to exercise the ARCO Rights has been sent, the Data Subject must confirm its receipt with the PRO BOSQUE DE CHAPULTEPEC Administrative Area, at the telephone number +52 (55) 5281.5382. The Personal Data Protection Area of PRO BOSQUE DE CHAPULTEPEC, will have a period of 20 (twenty) business days to provide an answer on the validity, or inadmissibility of your request. If your request is valid, the respective area will have 15 (fifteen) business days to grant the request. The foregoing subject to the terms set forth in the Law, which may be extended only once for an equal period, provided that it is justified by the circumstances of the case.

In case the information is not clear or sufficient, the corresponding area will require the necessary information and/or documents, which must be submitted within 5 (five) business days, if it is not done in time and form, the request will be deemed not submitted. On the other hand, in those cases in which the Data Subject exercises his/her right of access to information, the Trust will comply by making the corresponding Data available to the Data Subject, issuing simple copies, electronic documents or any other means that allows the Data Subject to access his/her Data.

  1. B) Withdrawal of consent; and Limitation on the use or disclosure of Data

The Data Subject can withdraw, at any time, the consent granted to the Trust for the processing of his/her Data, and request the limitation on the use or disclosure of the latter, only if it is not prevented by a legal provisions and/or your request is not applicable in terms of the Law.

For those effects, the Data Subject must submit a written request in digital format to the Public Relations Area of PRO BOSQUE DE CHAPULTEPEC, at the following e-mail address: contacto@probosquedechapultepec.org.

The request must contain (i) the name of the Data Subject; (ii) address or email to receive notifications; as well as (iii) documents proving the identity or powers of attorney corresponding to the legal representative of the Data Subject. The response to your request will be notified to you at the address or email that you have indicated for such effects and, if the response is valid, it will be effective within 15 days after the date on which the response was communicated. The foregoing subject to the terms set forth in the Law, which may be extended only once for an equal period, provided that it is justified by the circumstances of the case.

However, the Data Subject may obtain more information about the status of his/her request and the deadline for responding to it, by contacting the Trust or sending a request to the aforementioned e-mail, where they can also address any clarification or doubt that the Data Subject may have regarding the processing of his/her Data and his/her respective rights contained in this Privacy Notice.

If the Data Subject wishes to exercise his/her right to limit the use or disclosure of the Data and/or to stop receiving the Trust’s newsletter, he/she may unsubscribe from it at any time by clicking on the “unsubscribe” option at the end of all its communications. The disclosure of your Data is limited to the transfers referred to in Section IV above, which are indispensable to process the donations and issue the tax vouchers required by the Data Subject.

Additionally, the Data Subject may also go to or request by telephone its registration in the Public Registry of Consumers, and/or the Public Registry to Avoid Advertising, as provided in this regard by the Federal Consumer Protection Agency, through the applicable legislation. The Data Subject may also go to the Public Registry of Users provided by the Law for the Protection and Defense of the Financial Services User, in order to limit the use of personal data in possession of individuals.

  1. Remote means and technologies

If for any reason you provide us with your Data through electronic means, including in the Site and the App, You understand, and agree that:

  1. The Site and the App may include links to third party websites which, if accessed, will cause our Site or App to be abandoned, so we assume no responsibility in relation to third party websites;
  2. The Site and the App may include links to sites that administer social networks, in which case you agree that by providing any information, including your Data on such sites, it will cause it to be read, viewed, accessed, retransmitted, and processed by anyone, freeing us from any liability; and

III.         The Site, the App and our systems, including the Platform, may collect data in addition to what you provide Us, such as browser type, operating system, internet pages visited, IP address, etc. This is done through the use of cookies or web beacons, of our own and from third parties. In no case do cookies personally identify the users of the Site and App. The cookies may be disabled in accordance with the settings on the use of cookies of the browser or Internet service that the Data Subject uses. However, we inform you that the blocking by the Data Subject of all cookies may result in the total or partial blocking or impairment of access to and use of the Site.

On the other hand, we use “Google Analytics” services to analyze how users use the Site, including how often it is visited, previous sites and sections visited, this information is only used to improve and enhance our Site and service. The ability to use and store your information through Google Analytics when you visit the Site, is governed by the terms and privacy policies of Google Analytics and Google. Likewise, we use “Facebook Ads” services to enhance communication with potential donors who are interested in the cause, so the Site has the tool known as “Facebook Pixel “installed accordingly, which allows us to improve our communication through advertisements. The ability to use and store your information through Facebook is governed by the terms and privacy policies of Facebook. VII.        Amendments to the Privacy Notice

This Privacy Notice may be modified by Us to be consistent with applicable legal requirements at the request of the appropriate authorities and/or as We deem appropriate.

As long as we do not modify our identity, require more data from you than those mentioned herein, modify the purpose of this Privacy Notice, and/or change the terms of transfer, You understand and agree that the way to notify any change to this Privacy Notice, will be through its publication on the Site and/or the App. In the event that your consent is required for changes made to this Privacy Notice, We will notify You by any of the means of contact you have provided.

You will be deemed to have accepted the changes to the Privacy Notice until we receive any communication from you to the contrary. It is your obligation to periodically visit the Site in order to verify the most current version of our Privacy Notice.

The Privacy Notice will be governed by the laws of Mexico City without regard to its conflicts of law provisions. Any disputes, claims, and causes of action arising out of or in connection with this Privacy Notice, will be resolved individually, without resort to any form of class action. Any action or litigation concerning the Privacy Notice shall take place exclusively in the federal or state courts sitting in Mexico City, and each Data Subject expressly consents to the jurisdiction of and venue in such courts and waives all defenses of lack of jurisdiction and inconvenient forum with respect to such courts. Each Data Subject agrees to notify by mail or other method acceptable under the laws of Mexico City.

The present Privacy Notice is drafted in English and Spanish. The interpretation and compliance with this Privacy Notice shall be under the Spanish version.

Fideicomiso F/055 Pro Bosque de Chapultepec, en lo sucesivo “Pro Bosque” podrá solicitar información personal de sus donantes a través de su Sitio Web para efectos administrativos. Por lo tanto, la utilización de nuestro Sitio Web supone que usted ha leído y aceptado nuestras políticas de donación y privacidad, así como nuestros Términos y Condiciones de Uso.

Como cualquier otro sistema de procesamiento de tarjetas de crédito en línea, las entidades financieras  cobran una comisión por cada transacción realizada a través de nuestro sitio web, por lo que la cantidad de la donación que se realice se verá aumentada en virtud de dicha comisión, absorbiendo el donante el costo de la comisión.

CANCELACIONES /DEVOLUCIONES

No se aceptan cancelaciones ni devoluciones por un monto menor a $500.00 M.N. (quinientos pesos 00/100 Moneda Nacional).

Además, toda solicitud debe estar plenamente justificada, aunque esto en sí no garantiza la cancelación ni devolución, y el trámite debe ser autorizado por la Dirección del Fideicomiso Pro Bosque. Para cancelar una donación o solicitar una devolución de su dinero, es necesario que se comunique con Víctor Manuel Gutiérrez García, al teléfono (55) 52815382 ext. 102 o al correo vgutierrez@probosquechapultepec.org, dentro de las 24 horas posteriores de haberse efectuado la donación (excepto feriados y fines de semana).
DONACIONES RECURRENTES

Cuando usted ingresa su información de tarjeta de crédito a nuestro sitio, la misma será cargada por el monto indicado en el formulario de donación o periódicamente conforme a los cargos recurrentes que se agreguen a través de la página web o por comunicación con Víctor Manuel Gutiérrez García.

Nuestra plataforma virtual nos permite aceptar donaciones provenientes de todo el mundo utilizando cualquiera de las tarjetas de crédito aceptadas por los sistemas de pago utilizados por Pro Bosque.

Una vez procesada su donación, recibirá un acuse de recibo dirigido a la dirección de correo electrónico utilizada durante el proceso de donación.
